Terms for Commission

Commission Terms

Artistic Limitations

  • Subject Matter:
    • The Artist specializes in certain styles and subjects, and as such, she does not undertake commissions for landscapes, abstract art, or human portraiture. Her expertise lies in other areas, and this focus allows her to deliver high-quality and passionately crafted works within her chosen domains. Clients are encouraged to discuss their ideas and preferences within these parameters to ensure alignment with the Artist’s skills and artistic vision.

Client Responsibilities

  • Provision of Reference Photos:
    • The Client agrees to provide clear and useful reference photos for the commissioned Work. These photos will assist the Artist in accurately capturing the desired subject or elements as specified by the Client. The determination of the photos’ usefulness rests with the Artist, who will communicate any need for additional or alternative images.

Termination of Commission

  • Artist’s Right to Terminate:
    • The Artist reserves the right to terminate the project at any time, for any reason. Should the Artist decide to exercise this right, the Client will receive a full refund of any payments made, including the non-refundable down payment. This ensures that both parties are treated fairly and with respect, allowing the Artist to uphold her standards of quality and integrity in her work.

These additions to the commission terms ensure clarity and fairness for both the Client and the Artist, facilitating a smooth and collaborative creative process.

  • Size/Dimensions: [e.g., 9×12″]
  • Deadline for Completion:

Payment Terms

  1. Down–payment: The Client agrees to pay a non-refundable down-payment of $50 upon signing this Agreement. This down-payment is required to secure the commission and initiate the project.
  2. Balance Due: The remaining balance of the total agreed price, which is $125 shall be due upon completion and delivery of the Work.
  3. Payment Method: All payments shall be made via Paypal or Cash.

Delivery

  • Completion and Delivery: The Artist agrees to deliver the completed Work to the Client by the deadline specified above. Delivery will be made to the Client’s address or via an agreed method if the Work is digital.

Ownership and Rights

  • Upon full payment of the balance, the ownership of the Work shall transfer to the Client. The Artist retains the right to use images of the Work for portfolio purposes and self-promotion.

Specifications and Artistic License

  • The Artist will make every effort to meet the specifications outlined by the Client while adhering to her distinctive style. If the Client provides specific requests and guidelines, the Artist will incorporate these into the Work wherever feasible, ensuring the final piece aligns with the Client’s vision. However, if no specific requests are made, the Artist will exercise creative license, allowing her artistic intuition and expertise to guide the creation of the Work. This flexibility ensures a unique and original piece that reflects the Artist’s artistic flair.

Client Satisfaction and Dispute Resolution

  • If the Client is not satisfied with the completed Work, the Artist will retain the down payment as compensation for the time and materials used. In such a case, the project will be considered terminated. The Artist is committed to ensuring client satisfaction and will make reasonable efforts to address any concerns or requests for adjustments within the scope of the original agreement. However, if a resolution cannot be reached, the down payment will not be refunded, and the contract will be concluded.
